Please read these Terms of Use ("Terms") carefully. They contain the legal terms and conditions that govern your use of and access to our websites, mobile sites, and mobile applications as well as our provision of products and services. Certain services, promotions, and features may have additional terms and conditions, and those additional terms and conditions are incorporated herein by reference. By visiting any of our Sites and Apps, you are signifying your assent to these Terms and our Privacy Policy, which is incorporated herein by reference. Any products ordered or services used through any of our Sites and Apps are also governed by these Terms. We may revise these Terms from time to time by posting a revised version. YOUR CONTINUED USE OF ANY OF THE SITES AND APPS AFTER WE POST ANY CHANGES WILL CONSTITUTE YOUR ACCEPTANCE OF SUCH CHANGES. IN ADDITION, BY ORDERING PRODUCTS OR USING SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND REVIEWED THESE TERMS IN THEIR ENTIRETY, YOU AGREE TO THESE TERMS AND THE PRIVACY POLICY AND THESE TERMS CONSTITUTE BINDING AND ENFORCEABLE OBLIGATIONS ON YOU.
TRADEMARKS
All brand, product and service names used in the Services which identify Persnickety Box, are proprietary marks of Persnickety™. All brand, product and service names used in the Services which identify other entities and their products and services are proprietary marks of such third parties. Nothing in the Services shall be deemed to confer on any person any license or right on the part of Persnickety Box, or any third party with respect to any such image, logo, or name.
PURCHASES
All information that you provide to us or our third-party payment processor must be accurate, current, and complete. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY CREDIT CARD(S) OR OTHER PAYMENT MEANS USED TO INITIATE ANY TRANSACTION. You agree to pay all charges incurred by you or any users of your account and credit card.
PAYMENT INFORMATION
You agree to pay all applicable fees for all services provided to you. For all site access and subscription charges, your credit card will be billed directly. Recurring charges are billed at the time of service. You agree to provide an automatic credit card payment authorization, which will be used to charge services provided to you. By signing up for the Persnickety Box subscription, you authorize Persnickety Box to capture payment every month until the subscription is cancelled. Persnickety Box will send a notification each month when a new box opens. Payment will be captured on the subscription start day.
DELIVERY
Persnickety Box will process and ship photos within 3 days of closing a box, unless otherwise mentioned. Shipping costs are free to the user. Photo boxes will be delivered via USPS to the account address provided available for U.S. delivery at this time.
PRIVACY
You may create a member account with any of our Sites and Apps by registering your name, email address, and creating a password. You agree that you will provide complete, current and accurate information about yourself as requested, and that you will keep that information up to date. You are responsible for maintaining the confidentiality of the password and Membership information, and are fully responsible for all activities that occur under your password or Membership account. You will immediately notify us of any unauthorized use of your account on any of our Sites and Apps.
SERVICE CANCELLATION
You may close or pause your account at anytime by emailing our customer service team at admin@persnicketybox.com. You will not be able to access your data nor be charged for any goods or services following the closure of your account. In the event you would like to re-subscribe, you will not be eligible for any previous rates. Your account is considered closed at the timestamp of the email received indicating you would like to close your account. You will still be able to fill and close boxes in the app that have been opened and paid for.
The yearly subscription offers a discounted rate. Buy 12 boxes, get 2 boxes free. In the event of a yearly subscription cancellation, you will be refunded the pro-rated full-price amount per box PLUS the $6.99 processing fee. Example: 2 boxes have been shipped, you will be refunded $153.03. The one-year price of $199 - 2 boxes at $19.99 each - $6.99 processing fee.
DELETE DATA
You may delete all data by logging into your account in the app and going to Settings -> Support -> Delete Account.
PHOTO STORAGE
You are responsible for any internet connection fees and/or mobile carrier charges that you incur when accessing or using the App. Should you uninstall an App from your mobile device, you may not be able to use all or some of the features of the App. Images in the Persnickety Box App are reduced for efficient load times. Persnickety Box stores full-resolution images on our server for a total of 90 days. Persnickety Box is not responsible for photo storage.
AMENDMENT OF TERMS
You agree that Persnickety Box retains the right to amend these Terms and the Sites, including service offerings and prices at any time, for any reason, and without notice, and the right to terminate the Sites or any part of the Sites. You agree to review the posting of this Agreement periodically to be aware of such changes. Your continued use of the Sites constitutes acceptance of any amendments, additions, or modifications to this Agreement. Any amendments or modifications made by Persnickety Box shall be prospective only. You will be bound by all such modifications, whether or not you have notice thereof. If you continue to use the Service once you have been notified of the changes to these Terms, you will be deemed to have accepted those changes.
INDEMNIFICATION
You agree to indemnify and hold Persnickety Box, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of these Terms, or your violation of any rights of another.
BY CLICKING ON THE “ACCEPT” BUTTON, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT.
